Refunds for Covid-19 related changes

(AGB) General terms and conditions

General Terms and Conditions for the sale of tickets to the 7th International Cradle to Cradle Congress, as well as attendance at the event.


1.1. APPLICATION OF THE C2C NGO-AGB: These General Terms and Conditions govern:

(a) The sale of tickets to the 7th International Cradle to Cradle Congress 2021 through the Cradle to Cradle NGO.

  1. b) The sale of tickets for the 7th International Cradle to Cradle Congress 2021 via the distribution partner Pretix.
  2. c) The participation in the 7th International Cradle to Cradle Congress 2021.

1.2. APPLICATION OF DISTRIBUTOR AGB: The purchase of tickets via the distribution partner Pretix is based on the GTC of the C2C NGO.

1.3. APPLICABILITY OF THE ORGANIZER AGB: The events are carried out entirely by the C2C NGO. The contract to attend the event is concluded between the ticket purchaser and the event organizer.

1.4. CORRECT INFORMATION: The Ticket Purchaser bears the risk for the correct entry or provision of information in the order process, in particular regarding the selection of ticket, event, venue and date.

1.5. MINIMUM AGE: The purchase of tickets is only permitted to persons with a minimum age of 18 years and unrestricted legal capacity or with the consent of the legal representative.

1.6. PURCHASE CONTRACT: The contract between buyer and seller is concluded by the acceptance of a purchase offer by sending a ticket number by Cradle to Cradle NGO/Pretix and is subject to the condition precedent of full payment in due time.

1.7. INVOICES: Companies can request invoices during the purchase process or at . No invoices will be issued to other participants.

1.8. TICKET PROTECTION: To discourage unfair ticket trading, each ticket is issued in personalized form only. Please protect yourself from ticket fraud by not disclosing your ticket number and other information associated with your purchase to any third party.


2.1 TICKET PRICES: Ticket prices for the 7th International Cradle to Cradle Congress do not include VAT.

2.2. DUE DATE: The purchase price and fees are due for payment upon conclusion of the contract.

2.3. PAYMENT METHOD PROVIDER: In case of payment by a payment method provider, Cradle to Cradle NGO/Pretix assigns the payment claims against the buyer to the provider of the selected payment method; in this respect, the general terms and conditions of the respective payment method provider shall apply in addition.

2.4 DELIVERY: The tickets will be delivered by the shipping method chosen by the ticket purchaser after the conclusion of the contract, i.e., after full payment of the ticket price. To receive information about your purchase, please contact us at , indicating the ticket number provided to you after completing your order.

2.5 RIGHT OF CANCELLATION: According to § 312g paragraph 2 No. 9 BGB there is no right of cancellation.

2.6 RIGHT OF CANCELLATION: To exercise your right of cancellation, please contact Cradle to Cradle NGO by mail at Landsberger Allee 99c, 10407 Berlin or by e-mail at and provide us with a clear statement of your decision to cancel the said contract. A statement of reasons is not required. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period. In case of a valid revocation, Cradle to Cradle NGO is obliged to refund the purchase price of the tickets to you immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract.

2.7 REFUNDS: For any refund, we will use the same means of payment that you used for the original transaction. End of the cancellation policy. Refunds include the printed ticket price and will only be made to the original ticket purchaser.


3.1. GENERAL: The purchase of a ticket gives the purchaser the right to attend the event designated on the ticket. Tickets must be kept in a safe place upon receipt and protected from damaging after printing, as illegibility of the information on the ticket, which is important for admission control, may result in invalidation of the ticket and consequent loss of the right of admission.

3.2. PERSONALIZED TICKETS: The ticket will be personalized during the ordering process. Cradle to Cradle NGO intends to grant access to the respective event only to the ticket holders. For individually personalized tickets, identification is generally required at the entrance. Admission will only be granted to the person named on the ticket, if he or she can prove his or her identity at the entrance by means of a valid personal document, a valid driver's license or any other means of proof agreed upon with the organizer. If the organizer offers the possibility to personalize the tickets individually at the time of purchase, the Purchaser shall be requested during the ordering process and shall be obliged to truthfully state the first and last names of the additional persons for whom the personalized tickets are to be issued, when placing the order.

3.3. BUYER-PERSONALIZATION: In case of purchase of several tickets, which are automatically personalized to the Buyer's name, all tickets will be issued to the Buyer's name ("Buyer-Personalized Tickets"). Admission to the event under presentation of a buyer-personalized ticket, which is not issued in the name of the visitor seeking admission, is possible for the visitor only in the presence of the person named on the ticket, if he/she can identify him/herself at the entrance by a valid personal document, a valid driver's license or another means of proof agreed upon with the organizer. The holder of the right to visit the event is the purchaser, who is, however, entitled to visit the event in company, whereby a separate ticket personalized to the purchaser's name is required for each accompanying person.

3.4. IDENTITY CHECK: The organizer is not obliged to check identity at the entrance (digitally and on site). He shall also be released from his obligation to perform towards the purchaser if he grants access to the event to another person presenting the personalized ticket.

3.5. MISUSE OF THIRD-PARTY DATA: The misuse of third-party data in the purchase of personalized tickets without their declared or presumed will may lead to blocking.

3.6. REPERSONALIZATION: Re-personalization of tickets is only possible in consultation with the organizer, provided that the purchaser requests the event data, order number, order data (e.g., date of order and means of payment used) as well as the name of the visitor originally noted on the ticket and the name of the new visitor. Upon re-personalization, the originally named person loses the right to visit the re-personalization can only be made no later than 24 (twenty-four) hours before the start of admission to the booked event.

3.7. LOST AND STOLEN TICKETS: If tickets are reported as lost or stolen, they may be blocked in accordance with the Organizer's GTC with the consequence that the right to attend the event expires.

3.8. MISUSEFULLY OBTAINED, LOST OR STOLEN TICKETS: Tickets acquired in violation of these GTC or for which there are reasonable grounds to believe that a violation has occurred may be blocked by the Organizer after considering the interests of the purchaser with the consequence that the right to gain admission to the event expires. There will be no refund of the purchase price or fees. Cradle to Cradle NGO can prove a higher damage, the buyer is allowed to prove a lower damage.

3.9. NO USE OF TICKETS FOR COMMERCIAL OR COMMERCIAL PURPOSES; UNAUTHORIZED DISTRIBUTION: Tickets are sold exclusively for private, non-commercial use. Any commercial or business resale of tickets is prohibited. The commercial sale of tickets is reserved solely for the respective organizer and its authorized distributors. In particular, it is not permitted (a) to offer tickets for sale publicly by auction (e.g. on eBay) or to sell them, (b) to offer or sell tickets via ticket portals (e.g. at ViaGogo, StubHub, Ticketbande, etc.). ) for purchase or sale, (c) to pass on tickets at a higher price than the price paid, (d) to sell or pass on tickets to commercial or business resellers and/or ticket dealers, (e) to use or allow tickets to be used commercially or for commercial purposes, e.g. for raffle purposes, for advertising, marketing, as a promotional gift or as part of an unauthorized hospitality or travel package, without the prior written consent of the organizer. The transfer of tickets without the inclusion of these Ticketmaster GTC is not permitted. Ticketmaster or the respective partner for distribution reserves the right to block tickets affected by this and/or not to accept further ticket orders. This also applies in cases, where there is reasonable suspicion that you have used or will use automated programs to order Tickets. Subject to the imposition of a contractual penalty, a violation of the provisions of this paragraph will result in the loss of the access authorization without compensation, i.e., the ticket will lose its validity in this case.

3.10. PERMISSIBLE TRANSFER - PRINCIPLE: A private transfer of a ticket for non-commercial reasons, in individual cases in the event of illness or other prevention of the customer, is permissible, provided that there is no case of impermissible transfer in the sense of the GTC. In this case, the customer can only transfer the rights and obligations arising from the visitor contract to a third-party by the third party entering into the visitor contract in his place and assuming all rights and obligations. This entry requires the consent of the seller.


4.1. PRECAUTIONS: In the event of a culpable violation of one or more provisions under these GTC, the Seller shall be entitled to impose a contractual penalty on the respective Customer to be determined by the Seller at its reasonable discretion (§ 315 BGB), the appropriateness of which may be reviewed by the competent court in the event of a dispute.

4.2. AMOUNT: The amount of the contractual penalty shall be determined in particular by the number and intensity of the violations, the type and degree of fault (intent or negligence), the efforts and successes of the customer or ticket holder with regard to making good the damage, the question of whether and to what extent the customer is a repeat offender, and, in the case of unauthorized resale of tickets, the number of tickets offered, sold, passed on or used, as well as any proceeds or profits generated by the resale.



The organizer may change the program if special occurrences or events beyond the organizer's control make this necessary. In this case, there is no right to exchange the tickets or refund the ticket price, as long as the change is insignificant.

5.2 CANCELLATION, CANCELLATION OR POSTPONEMENT OF EVENTS: In the event of cancellation or postponement of events for which the organizer is responsible, as well as in the event of other occurrences that give rise to claims against the organizer, the ticket purchaser's claim is only against the organizer and is limited to reimbursement of the face value of the ticket. Travel and accommodation costs or similar will not be reimbursed. If an event is cancelled, interrupted, or postponed due to a circumstance for which the organizer is not responsible (e.g., force majeure), the visitor's right to withdraw from the contract is excluded. In the event of cancellation or discontinuation, the organizer will make up for the event as far and as soon as possible and reasonable. If the event is postponed or - in case of cancellation or termination - made up, the tickets for the event remain valid.


6.1. UNLIMITED LIABILITY: The Cradle to Cradle NGO, its legal representatives, officers or agents shall be liable without limitation under the laws of the Federal Republic of Germany (i) for damages resulting from injury to life, limb or health, (ii) for willful misconduct or gross negligence, (iii) under the Product Liability Act, and (iv) in the event of the assumption of guarantees.

6.2. LIMITED LIABILITY: Cradle to Cradle NGO, its legal representatives, officers, or agents shall only be liable for slight negligence in the event of a breach of a "material" obligation under these GTC. "Essential" obligations are those that are necessary in each case for the fulfillment of the contract for the sale of tickets and implementation of own events, the violation of which would jeopardize the achievement of the purpose of the contract, and on the compliance with which the ticket purchaser may therefore regularly rely. In these cases, liability is limited to typical and foreseeable damages.

6.3. INDEMNIFICATION FROM CLAIMS: Insofar as the Ticket Purchaser is at fault; he shall indemnify the Seller/Organizer from all claims asserted against the latter by third parties due to the conduct of the Ticket Purchaser in connection with the purchase of Tickets or the staging of Ticketmaster's own events and shall bear the legal defense costs incurred in this respect in the statutory amount. In the event of a claim by a third party, the Ticket Purchaser is obligated to immediately provide the seller/organizer with truthful and complete information that is necessary for the examination of the claims and a defense.


7.1. APPLICABILITY: The following conditions for attending events apply to all events.

7.2. ADMISSION AND PARTICIPATION IN AN EVENT: When attending an event, the rules and regulations of the organizer and the venue (hereinafter collectively referred to as the "Rules of Conduct") must be observed. Rules of conduct also result from the house rules of the respective venue, notices there, instructions from service personnel or announcements. A violation of the Rules of Conduct or unacceptable behavior that is likely to cause disruptions during the event, damage to the venue, safety devices or stage equipment, or cause a significant nuisance or infringement of the rights of others, entitles the organizer to expel the visitor from the venue. The same applies to refusal of admission.

7.3. ENTRY CONTROL: The assigned security personnel may conduct searches of persons and carried bags, etc. at the entrance of a venue in order to ensure the safety of visitors or compliance with the rules of conduct.

7.4. IMAGE AND SOUND RECORDING BY THE EVENT ORGANIZER: Cradle to Cradle NGO points out that image and sound recordings are made at events and that visitors as part of the audience may be affected by this. It is the responsibility of the visitor to inform himself/herself about the making of such recordings before purchasing the ticket from the event organizer.

7.5. CARRYING OF OBJECTS, ANIMALS, FOOD OR DRINKS: The use of lasers or cell phones may be prohibited, as well as the carrying of animals except for guide dogs. The same may apply to food or beverages. It is the responsibility of the ticket purchaser to inquire about any such restrictions with the promoter or venue prior to purchasing tickets.

7.6. LATE ARRIVAL: Late arrivals have no right to be admitted immediately. The organizer will try to admit latecomers at a convenient time that does not disrupt the performance, e.g., during an intermission.

7.7. LEAVING THE PERFORMANCE PLACE BEFORE THE END OF THE EVENT: In case of leaving the venue before the end of the event, another admission may be denied


8.1. PROVIDING CONTACT TRACKING DATA AS A CONDITION OF ENTRY: For your safety and the safety of other event attendees, the organizer of an event may collect certain data from individuals attending the event (e.g., first name, last name, phone number, and/or well-being information, hereinafter referred to as "contact tracking data") to enable contact tracking and prevent the spread of Covid-19. It is a condition of entry that all ticket holders who wish to attend such event provide Contact Tracking Data when requested to do so. By purchasing the ticket, the purchaser agrees to provide complete and truthful information to the event organizer in a timely manner via the means we provide (e.g., an online form or via a check-in desk at the event). Cradle to Cradle NGO will contact the purchaser in a timely manner, informing if the event organizer requires contact tracing data for the event and how and when such data must be provided. Contact tracing data will be collected and processed in accordance with the respective organizer's privacy policy.

8.2. If a Ticket Holder who wishes to attend an event for which the provision of data is required pursuant to section 10.a violates the obligation in section. 10.a, the organizer shall be entitled to deny such Ticket Holder admission to the event without entitling the Ticket Holder to a refund of the ticket price.

8.3. If a buyer intends to sell or otherwise pass on a ticket for an event where participants are required to provide contact tracing data, these GTC must be agreed to by the third party as part of the transfer, in particular the requirement of the participant to provide complete and truthful contact tracing data in a timely manner through the means provided.


9.1. INVALIDITY OF REGULATIONS: The invalidity of individual provisions shall not affect the validity of the remaining provisions.

9.2. APPLICABLE LAW: The law of the Federal Republic of Germany shall apply exclusively to the exclusion of the German International Private Law (IPR) and the UN Convention on Contracts for the International Sale of Goods (CISG).

9.3. PLACE OF PERFORMANCE AND JURISDICTION: The sole place of performance for deliveries, services as well as payments is Berlin, provided that the Ticket Purchaser is an entrepreneur within the meaning of § 14 BGB (German Civil Code). If the Ticket Purchaser is an entrepreneur, Berlin shall be the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. In the case of cross-border contracts, this shall also apply to consumers; in this case, the Cradle to Cradle NGO reserves the right to also invoke any other internationally competent court.

9.4. ONLINE DISPUTE RESOLUTION: The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at The e-mail address of the Cradle to Cradle NGO is . The Cradle to Cradle NGO is neither obligated nor willing to participate in the dispute resolution procedure.

9.5. TRANSFER OF RIGHTS: The Cradle to Cradle NGO is entitled to transfer rights and obligations from this contractual relationship in whole or in part to a third party with a notice period of four weeks.
